CPD Workshop for Arbitrators and Conciliators
Overview, Aim and Programme
This workshop is intended for those who are likely to be involved in dispute resolution whether arbitration, conciliation, mediation or adjudication either as third-party neutrals or as a party. It will feature a range of speakers with wide experience of all dispute resolution processes and the emphasis will be on issues likely to arise and how they should be dealt with.
The main focus of the workshop will be on arbitration and conciliation but it will cover aspects likely to be encountered in any dispute resolution process such as the powers of the arbitrator/conciliator, management of the process, problems likely to be encountered while parties are presenting the case, assessment of the issues and the writing of an award/recommendation/determination. These skills are common to all dispute resolution processes and consequently will also apply in adjudication as anticipated in the Construction Contracts Bill.
The workshop will feature presentations as well as interactive question and answer sessions. Participants will also be provided with details of a mock case and encouraged to write and return an award or recommendation. There will be no assessment of such determinations but a further breakfast meeting will be arranged for discussion of the participants' submissions.
